The Strata Property Act in British Columbia

The Strata Property Act (the Act) provides a framework for the creation and operation of strata developments in British Columbia, and sets out the guidelines under which strata corporations must operate․ The legislation provides for strata corporations to operate and make decisions based on democratic principles․

All British Columbia strata corporations must comply with the Strata Property Act․ Strata corporations need to also be aware other legislation may apply depending on circumstances, such as the Personal Information and Protection Act (PIPA), Residential Tenancy Act and the Human Rights Code․

The Strata Property Act, regulations and the strata corporations bylaws and rules provide the legal framework under which all strata corporations, including strata-titled duplexes, must operate in British Columbia․ This legal framework is also affected by decisions from the Civil Resolution Tribunal, court cases and other legislation․
